Terms of Service

1. Acceptance of Terms
By accessing or using the SnowBear platform ("Service") operated by Lumos Works AI, Inc. ("Lumos Works AI," "SnowBear," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Service Description
SnowBear is an AI outreach agent that helps users research companies, open roles and people, draft and send personalized LinkedIn and email outreach, and follow up, through the web app, email, SMS, Slack and connected AI assistants. Anyone who meets the eligibility requirements below can sign up for free. Paid plans and additional credits are optional.
3. Eligibility
You must be at least 18 years old to use the Service. By using SnowBear, you represent that you are 18 or older and that you are authorized to act on behalf of any organization for which you use the Service.
4. SMS Consent
By entering your mobile number on SnowBear's website and tapping Continue, you agree to receive a one-time verification code by text from SnowBear, a product of Lumos Works AI, Inc. (one message per request). By texting SnowBear, you agree to receive conversational SMS messages from SnowBear. These messages may include waitlist and access availability updates, onboarding messages, login verification codes, requested task updates, and replies from the SnowBear AI assistant.
Consent to receive SMS messages is not a condition of purchase or access to the Service. Consent records are retained as proof of opt-in.
Verification codes are sent one per request; other messages vary in frequency. Message and data rates may apply. Reply STOP to opt out and START to opt back in. Reply HELP for help. 5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to harass, spam, or harm third parties.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Use the Service in any way that could damage, disable, or impair it.
6. AI Disclaimer
SnowBear uses AI models to generate responses and research. AI-generated content may contain errors, inaccuracies, or outdated information. Nothing in the Service constitutes legal, financial, medical, or professional advice. You are responsible for verifying any information provided by the Service before acting on it.
7. Intellectual Property
The SnowBear platform, including its software, design, and content, is owned by Lumos Works AI, Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, Lumos Works AI's total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the greater of (a) $100 or (b) the total amount you paid to us in the 12 months preceding the claim.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. As the product evolves, we may change or discontinue features of the Service.
10. Changes to Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email or through the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
